3. Usage Limits
Unless otherwise stated, we or our licensors own the intellectual property rights in the website and material on the website. Subject to the licence below, all these intellectual property rights are reserved.
3.1 Usage Allowance
Users can use the service up to 100% of your allocated resources as specified in your subscription plan.
3.2 Over-Limit Policy
Users can exceed your allocated resources by up to 20% (120% of your plan limit). If usage exceeds 120% of the allocated resources, we will enforce a hard stop and temporarily suspend access to the service until users bring your usage back within the allowed limit.
3.3 Notifications
Users will receive notifications when your usage reaches 80%, 100%, and every 2% increment beyond 100% up to 120%.
3.4 Reinstatement of Service
To reinstate access after exceeding the 120% limit, upgrade your subscription plan.
3.5 Review and Adjustment
We reserve the right to review and adjust usage limits and over-limit policies as needed to ensure fair use of the service for all customers. We will communicate any changes to users in advance.
4. User Accounts
To access certain features of our Services, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your account password and for any activities or actions under your account.
5. Acceptable Use
You agree to use our Services only for lawful purposes and in a manner that does not infringe the rights of, restrict, or inhibit anyone else's use and enjoyment of the Services. Prohibited behavior includes, but is not limited to, transmitting obscene or offensive content, harassing or causing distress or inconvenience to any person, and distributing harmful or malicious software.
6. Limitation of Liability
To the fullest extent permitted by law, HTML2PDFRocket shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from your use of our Services, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses. Our maximum liability in relation to any event or series of related events will be limited to $10 USD. You hereby indemnify us and undertake to keep us indemnified against any losses, damages, costs, liabilities, and expenses (including without limitation legal expenses and any amounts paid by us to a third party in settlement of a claim or dispute on the advice of our legal advisers) incurred.
7. Termination
We reserve the right to terminate or suspend your access to our Services at any time, without prior notice or liability, for any reason, including but not limited to your breach of these Terms. All provisions of the Terms that by your nature should survive termination shall remain in effect, including but not limited to ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
8. Purchases and Credit Balances
If you are a resident of Australia, an additional 10% GST is added to your invoice. Unless otherwise stated in this document, or the reseller terms and conditions, no interest or other financial charges will be applied to account balances. HTML2PDF Rocket reserves the right to change the fees charged for any of our Services or products at any time. In the event that we introduce a new service or product, the fees for that service are effective at the launch of the service unless otherwise stated.
9. Exclusion of Third-Party Rights
These terms and conditions are for your benefit and ours, and are not intended to benefit any third party or be enforceable by any third party. The exercise of your and our rights in relation to these terms and conditions is not subject to the consent of any third party.
10. Assignment
We may transfer, sub-contract, or otherwise deal with our rights and obligations under these terms and conditions without notifying you or obtaining your consent.
12. Governing Law
These Terms shall be governed and construed in accordance with the laws of the Commonwealth of Australia and the state of New South Wales, and any legal action or proceeding arising under these Terms will be brought exclusively in this legal jurisdiction.
